As of May 28, 2024, the U.S. Federal Maritime Commission (FMC) has implemented new regulations regarding demurrage and detention charges from ocean carriers. These changes are intended to provide clarity and fairness in the billing practices of the shipping industry.

The Final Rule aims to address concerns about how demurrage and detention charges are invoiced and collected by ocean carriers, marine terminal operators, and non-vessel-operating common carriers (NVOCCs). To ensure transparency and proper billing practices, the FMC has outlined specific requirements for issuing invoices, disputing charges, and requesting fee mitigation, refund, or waiver.

  • Invoices will now be sent directly to the cargo owner or consignee, who is the ultimate recipient of the cargo. Vessel-operating carriers (VOCCs), marine terminal operators (MTOs), and non-vessel-operating common carriers (NVOCCs) have specific timelines for issuing invoices.
